Facts: • On Sunday, December 28, 2014 Mr. XXX stayed at City Bistro Hotel • At approximately 730am, Mr. XXX awakened to an itchy sensation on his toe • Mr. XXX got out of bed and turned the lights on to see if anything was bitting him when he noticed a bug on the sheets. • Scratching his arm, Mr. XXX noticed welts and bite marks on his arms and torso. • Mr. XXX confirmed this by looking in the bathroom mirror • Mr. XXX took pictures and video of the bite marks on his body and the bugs in the bed • Mr. went to the front desk of the hotel to notify them of the situation; video was shown to the clerk, as well as the injuries • The hotel clerk said she would send someone up to verify the situation • Mr. XXX waited until 9am before leaving the room; no one form the hotel ever came to verify the infestation • At that time, the hotel manager, Mr. McDowell witnessed the video and injuries and immediately refunded the fee for the night • Mr. XXX asked Mr. McDowell about compensation for his injuries but Mr. McDowell declined • Mr. XXX, in fear of further infestation to his car and to his home, and in an effort to mitigate his losses, threw away his luggage which had been in the infested room. Issue: 1. Whether City Bistro et al were negligent in its duty of care by allowing the condition to exist or did they fail to warn Mr. XXX of the associated danger? 2. Whether City Bistro et al breach their duty of Implied Warranty of Habitability? 3. Whether the infestation at the hotel a breach of Mr. XXX’s right to sanitary conditions? 4. Whether City Bistro’s failure to provide sanitary conditions create an intentional tort of Battery? 5. Whether City Bistro’s knowledge of the unsafe conditions by its failure to provide sanitary conditions constitute deception?
